Terms of Service

Last changed 15 October 2026.

Parties and scope

These Terms of Service (the “Terms”) are an agreement between you and Commentware (“we”, “us” or “our”). They govern your access to and use of this website (the “Website”) and of the software that we publish through it, including the Chrome extension, its installer, and the server and other packages that we publish in our registry, wherever that registry is reached (together, the “Software”).

By accepting these Terms, or by using the Website or the Software, you agree to be bound by them. If you use the Website or the Software for an organization, you also agree to these Terms on its behalf, and you confirm that you are authorized to do so. If you do not agree to these Terms, you must not access or use the Website or the Software.

Invite codes

An invite code is personal to the person to whom it is issued. You must not publish an invite code or pass it on to any other person. We may revoke an invite code at any time.

The Software

The Software is owned by Commentware, and all rights in it are reserved. We grant you a free, personal, non-exclusive, non-transferable and revocable license to install and use the Software for yourself or for your organization, for as long as these Terms remain in effect between you and us.

You must not, without our written permission, sell, rent, sublicense, publish or redistribute the Software, or offer it to others as a service. You must not remove any notice from the Software, or reverse engineer it except to the extent that applicable law permits.

Certain components of the Software are made by third parties and are licensed under their own terms, which are included with the Software. Those terms govern those components in place of the license granted in this section.

Your server and your data

You operate the server yourself, on a machine of your choosing. Your comments, screenshots and settings are stored on that machine, and we do not receive them. The Privacy Policy states exactly what data is transmitted and what is not.

You are responsible for that machine, for backing up the data stored on it, and for every person and AI agent to whom you issue an access key. We are unable to recover data from a server to which we have never had access.

Your content

You are responsible for the content you write and capture. Because a comment may include a screenshot of a web page, you must use the Software only on websites that you build or are authorized to work on, and only in a manner that respects the rights and privacy of others.

Acceptable use

You must not use the Website or the Software to violate any applicable law, to access any system that you are not authorized to access, or to place a load on the Website or its registry that prevents others from using it.

No warranty

The Website and the Software are provided “as is”, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

In no event shall we be liable for any claim, damages or other liability, whether in an action of contract, tort or otherwise, arising from, out of or in connection with the Website or the Software or the use of or other dealings in them.

Termination

You may stop using the Software at any time by uninstalling it. We may cease to offer the Website, the registry or the Software, or terminate your license if you breach these Terms. The sections titled “No warranty”, “Limitation of liability” and “Governing law” survive termination.

Amendments

We may amend these Terms. The date at the top of this page states when they were last amended. Your use of the Website or the Software after an amendment constitutes your acceptance of the Terms as amended.

Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute concerning these Terms shall be brought in the state or federal courts located in Delaware, and each party submits to the jurisdiction of those courts.

General

These Terms and the Privacy Policy constitute the entire agreement between you and us concerning the Website and the Software. If a court holds any provision of these Terms unenforceable, the remaining provisions remain in effect. A failure by either party to enforce any provision is not a waiver of it. You may not transfer these Terms to any other person; we may transfer them to any successor to Commentware.

What the website and the software store, and where it goes, is in the privacy policy. The licenses that come with the software are listed on the license page, and the legal page lists all three.
